Phelps Construction Group, LLC is a  New Jersey Limited Liability Company. The services provided by PCG include pre-construction, general contracting, and construction management services to meet all of a client’s construction needs from the initial conceptual budget through to the completion and maintenance of the new facility.

If you do choose to visit the Site, register with the site, or use any services provided by the Site, you must agree to the PCG’s Terms of Service, which is the contract between us and you. By accepting the Terms of Service, you also confirm that you have read and understand this Privacy Policy.  a) Personal Information you provide to us.

In connection with your use of the Site, you inform us of your marketing and communications preferences, and if you post or submit any text, comments, photo, video, communication, information, or other material, (“User Content”) on or through the Site, you will provide us with your identity, contact information, and IP address.  This data is collected through direct solicitation and your voluntary submissions. All User Content submitted by you in connection with your use of the Site may be retained by us indefinitely. We may continue to disclose such content to third parties in a manner that does not reveal Personal Information, as described in this Privacy Policy. We may receive a confirmation when you open an email or other message from us. We use this confirmation to improve our customer service.

The Site does not use third party advertising providers to display advertisements based on your visits to the Site and other web sites you have visited. The Site uses a third party traffic measurement service to analyze how visitors registered users the Site. Cookies, web beacons and embedded scripts and other similar mechanisms used to collect web site usage information from advertising providers and advertisers, are governed by their respective privacy policy and not this Privacy Policy. Investigations. We may use your information to detect, investigate and defend against fraudulent or unlawful activity and violations of the PCG’s Terms of Use [LINK].


7. International transfers

This Site is hosted on servers located in the United States; however, PCG will endeavor to meet those data protection laws and regulations (including the General Data Protection Regulation, or “GDPR”) and the U.K. Data Protection Act 2018, to which it may be subject.  

In respect of transfers outside of the Company, we either implement the Model Clauses pursuant to Commission decision 2004/915/EC or 2010/87/EU (as appropriate) with the recipient of your Personal Information; and/or ensure that the recipient of your data is registered with the EU-US Privacy Shield.

The safety of your Personal Information is important to us, and we use various technical and organizational measures to secure it.

Our data environment is monitored 24/7 for malicious activity and/or anomalous behavior either of which triggers our incidence response. Contractors Who Work for Us: We work with third party contractors to help us provide the Services and to otherwise assist us in the operation of the PCG network, including in the areas of email management and deployment, analytics, marketing, advertising, market research, site administration, credential validation, and customer services. We may provide these contractors with personal information about users of our Services so that they can fulfill their responsibilities to us, however, we do require that they agree to limit their use of this personal information to the fulfillment of these responsibilities.

Consent: We may disclose your personal information to a third party in a manner not addressed by this Privacy Policy subject to your consent at such time.

Aggregated Information. We may provide aggregated information about Site visitors and Members to third parties as we deem appropriate in our sole discretion. For example, We may tell a customer what percentage of registered users of the PCG Network reside in a particular geographical area or specialize in a particular market vertical, or what percentage of participants in a market research survey selected a particular response to a survey question.

Social Widgets: We may include social widgets within the Sites and Apps which enable you to interact with the associated social media services, e.g., to share an article or other information. These widgets may collect browsing data which may be received by the third party that provided the widget, and are controlled by these third parties. You may be able to manage your privacy preferences directly with the applicable social network platform.

Business Transfers: We may share your information among the respective websites that we own and with our subsidiaries, affiliates and companies acquired by or merged with us and our affiliates. In the event of a corporate change in control resulting from, for example, a sale to, or merger with, another entity, or in the event of a sale of assets or a bankruptcy, we reserve the right to transfer your personal information to the new party in control or the party acquiring assets. In the event of such a change, your personal information will continue to be treated in accordance with this Privacy Policy, as may be modified as described below.

Choice and Control

Account Information. You may update your User profile at any time through the Account Management feature available the PCG website. You may also contact Support at support@PhelpsConstructionGroup.com and request that your User profile information be updated or deleted. Note that if we delete your account, we may maintain certain de-identified information about you for internal business purposes including research, analytics and reporting.

Cookies. Most browser software can be set to reject all cookies, including third party cookies, however, if you choose to reject our cookies, your ability to access and use the Services will be limited.

Email Communications. If you no longer wish to receive email communications from us, you may unsubscribe by clicking the "unsubscribe" link located at the bottom of the email and following the instructions. You may manage your newsletter subscriptions within the newsletter subscriptions area within your account settings. Note that certain email communications that Users are service-related and as long as you are a registered with the PCG Network, you may not unsubscribe from such emails. Also, if you have provided us more than one email address, we may continue to contact you using the other email address not associated with the emails from which you have unsubscribed, until you unsubscribe from emails sent to that other address.

Push Notifications. We may send you push notifications from time-to-time to notify you of upcoming events or promotions we think may be relevant to you. If you no longer wish to receive these types of notifications, you may turn them off at the device level.

California Residents. Section 1798.83 of the California Civil Code requires select businesses to disclose policies relating to the sharing of certain categories of your personal information with third parties. If you reside in California and have provided your personal information to us, you may request information about our disclosures of certain categories of personal information to third parties for direct marketing purposes in the preceding calendar year. Children's Privacy. The PCG Network and the Services are designed and intended for use by adults, and are not intended for nor designed to be used by children under the age of 18. We do not collect personal information from any person we know is under the age of 18.
